Not fixed. I'm not saying if the girl is clearly giving it away when she's drunk, or thrusts her head in your lap and blows you while she's drunk, that that's rape. Because that would be fucking dumb. But if you have to actively and willfully coerce, 'exploit' or 'take advantage' of the girl to get what you want... it's rape. False equivalence is when one claims two things are equivalent when they are only share one element or characteristic. There are multiple congruities between the situations I'm comparing. It's not completely equivalent, but not being completely equivalent is not the same thing as being a false equivalence.
