They didn't sue because THJ was making money, they sued because DBG was losing money. QED, they would have sued regardless of how much money THJ made, they would of sued even if they never took a single cent in donations. They sued because THJ made a far more popular game that (they allege) took paying customers away from their business.

Now it's been argued that there was very little, if any, actual cross over between players looking for a pure Solo/offline dad version of EQ and EQ live players, either the "52 bot armies" on live servers or the "reliving the glory days but this time maybe you wont be a shitter" TLPers who rehash vanilla through PoP year after year until they relax the true box rules and let botters take over. And what little cross over there was, any and all good will was immediately vanquished when DBG sued their fans. Its also been understood by everyone with above a room temperature IQ that it was actually the shit ruleset chosen for Fangbreaker that is responsible for their loss revenue and had little if anything to do with THJ.

If thj hadn't been raking in donations they wouldn't have been as visible on daybreaks radar. They were known to be taking in profits of some unknown quantity at the same time that dbg devs are likely being eviscerated by their suits because fangbreaker was a total dud and they wanted a scapegoat. Had thj been quieter, maybe they scoot by. There's plenty of argument for emu success just being because they're free. Thj clearly wasnt TOTALLY free - they were raking in cash. Lots of it, it turned out.

According to sworn statements and affidavits submitted to the court of California by DBG they literally did not know about the donations, the email warning them of it went into a spam folder. They did not learn about THJ until after fangbreaker failed to launch in May(?) and they realized they were "missing players" that they would normally expect on TLPs (and missing the revenue/kronos from those players) and went looking. This is what they swore on penalty of perjury.
Now do we all think they are lying? Sure, but if you had any evidence of this i'm sure THJ guys would love it since the fucking trial is still upcoming. In fact, they have about 1 million reasons (and another 100k reasons per month) to care about this evidence you have that can prove that daybreak lied to the court so if you have something you should reach out to them i'm sure they'd gladly pay you a finders fee for it

If you read Daybreaks response to Laches they didn't actually know THJ was taking "donations" until after they started working on the lawsuit.

I played with rogean in roi. I would be completely shocked if p99 profits are outpacing even half of what he could make in his day to day doing what he did. I dont know secrets as well but I recall he makes or made fat stacks as a programmer of some sort.
Not that it matters much. The claim was money put then on the rader, the rebuttal was retarded, and we're all retards going on about it. THJ argued that DBG knew about their emulator and its popularity, knew it was making money for almost a year before attempting to file a surprise emergency injunction only after their own offering, Fangbreaker, failed on launch. Since they knew and allowed to run (just like every other of the thousands of emulators over the last 20 years, many/most of which also made money) then there was no basis for an emergency injunction, if it was an emergency they would of filed immediately back in 2024.
Granted, that is most likely the truth.
HOWEVER, DBG argued that they did not know about THJ, the email warning them about it went to a spam filter. it was developed and grew without their knowledge and certainly without their consent, and the moment they learned about it, from the drop in expected players from their annual TLP offering, ie from DBG's loss in revenue, they investigated and then immediately filed an injunction to shut it down.

Not only does it matter it's the central point behind both the reasoning for suing THJ and the harm claim. The claim isn't just that "money put them on the radar" it's that how much and how the money was being attained that put them on the Radar. Also that if THJ didn't exist that money would've made it's way to Daybreak. But according to Daybreak they didn't know how much or how until after they decided to sue. How much and how is supposedly the reason for why they didn't also sue p99, Quarm, PEQ, EZ server ECT.
But in reality the reason is simply THJ was popular at a time DBG was failing. Rather than admit to the suits at EG7 that profits were down because of lackluster expansions, failed TLPs, disappearing Krono scandal, Tower gear on Teek, rampant cheating, inconsistent rules enforcement ect. DBG looked for a scapegoat and found one in THJ and now that THJ is gone those players haven't gone back to Live/TLPs because they have no interest in Live/TLPs
