Bet there's a lot of DBG employees in on the krono selling game making some $$ on the side.

I wouldnt be shocked if the "Asian" Bot crews that sell loot plat and PLs and drive the entire sale of krono are all DBG staff. Pay them 60 grand a year and then they sell Krono for double that.

I was gonna say if FoH is showing up in the court documents, we've got someone from Daybreak here somewhere. Might as well try and give them the feedback they so desperately need. In a perfect world a court could compare the services of Daybreak and THJ, and then be able to rule in THJ's favor since Daybreak has been absolute ass for all the reasons xmod2 just listed.
Possibly, but not necessarily. A few related points:

-Holly from DBG had an account here briefly iirc, but she's now at... Blizzard, I think? So not really relevant. I think there may have been another dev or 3 with an account here too, but that was like 5-6 years ago at least that I even paid any attention to this. All that was related to that big EQ QnA thread that Suineg worked quite successfully on at the time.

-This is the public facing section of the forum. Anyone can look at it without registering an account.

-I don't know if it's still the case, but Suineg said that when he researched it, FOH was the #2 site for (current) EQ-based or related forums/discussions, after the official forums. This means it's completely natural for DBG to be following along here to any related EQ developments. Everyone who's here and posting about anything EQ related should keep that fact in mind.

-We might be named, but I've received no contact from DBG -that I'm aware of- that we've done anything wrong here. For everyone's info.

-I don't think that showing you made no profit, but did make income from the IP will save THJ here. I'm pretty sure you can get sued (and lose) for even using the IP without permission for free depending on the circumstances, so GL. Guess you're just at the whim of the system at this point.

Legally, THJ has no leg to stand on. I guess it comes down to how much do they care about the business versus just reaching an "understanding" with people that obviously have a passion for the game. Either way, THJ is going to lose some money out of their pockets but I hope that Daybreak finds a way to turn this into a win for Everquest. I'm doubting that will happen but we'll see.

Isnt Daybreak owned by a foreign investment firm? All they care about is money. So I wouldn't have any hope of some mutual agreement. At most and probably a small chance, but they hire/pay the people who coded all the stuff that made THJ unique and stick that in some server they control so people have to sub to play it, just keep it separate from all their TLP/Live servers. As it sounds like a very have fun for a month and be done type server.

Lets all hope they allow the server to continue in some fashion. Or maybe emulate some of the good ideas on live EQ. Maybe some of the other emulators will implement some of the good ideas.

If they intended to do that - they would have done it without upsetting the community by threatening the most popular server in recent memory.
The cost to them will be real.
They already fucked up. Lets hope they come to their senses. Again, not expecting it.

  1. Daybreak did want to keep the entire thing private, judge denied
  2. they will 100% win legally
  3. they have a history of allowing emulators(officially) so there is a chance at an agreement
  4. they would lose a huge chunk of fan base, reputation, and clout if they crush these guys. Not great for a slowly dying IP

essentially it is in all parties interest to reach some type of agreement. DBG did officially sanction P99 so it’s possible they try to find middle ground here.

it would be in their best interest to find a way an incorporate as much of THJ into their own servers as possible. Or….you know….they just fucking crush them and the basically dead EQ gets a final blow

P99 is also a registered non-profit entity, in a state which has a clear conservative definition of what a non-profit is. P99 had to adhere to existing law-- whether DBG reached an agreement with them or not.

Was THJ a registered non-profit corporation like P99?

If not, what type of entity was THJ doing business as? Was THJ an S-corp owned by the founder doing for-profit business?

To get a deal like P99-- these questions matter.
