Not necessarily. All that really matters in modern business is who can afford the better lawyers and how long you can afford to pay them. Any business worth anything is usually in a lawsuit of some sort. And typically more than one. It takes a long time to get a court date for business lawsuits, usually over a year. In the mean time you are going through discovery and all the other bullshit that takes up valuable time from actually doing the work required to keep your business profitable (and able to pay the lawyers).

A settlement is usually reached a long time before the trial ever starts. It doesn't matter if you are right if it takes everything you own to prove it. If the state or the feds get involved, then that is a different matter. They don't care about spending other peoples money on lawyers. But if it's just business people suing each other then a settlement where both sides lose is almost guaranteed.
