Smedley was in charge of the EverQuest franchise from its early success all the way through its decline, and the results speak for themselves. As president of SOE, he led every major decision, from the disappointing direction of EverQuest 2 to the hype and eventual cancellation of EQ Next, while failing to adapt to what players actually wanted or to learn from games like World of Warcraft. Under his leadership, SOE became known for missed opportunities, stalled projects, and a lack of clear vision. The franchise declined so badly that Sony eventually sold off SOE and rebranded it as Daybreak Games to save face. Smedley wasn’t just in the room, he was the one steering the ship.

The buck stops with Smedley. He got lucky with EQ and has not been able to replicate that success while continuing to be gainfully employed as a "leader" in the industry. In almost any other industry, especially one that prioritizes performance, accountability, or tangible outcomes, John Smedley's track record would have ended his executive career years ago.

Not that it really matters to anything to do with current EQ or the lawsuit but on the topic of EQN and Smedley leading its depressing failure:

I do remember seeing Smedley involved with promoting EQN and launching that landmark alpha or whatever you call it that ran like shit on my computer. Yeah he was gone when they canceled it, but guessing his leadership as President at SOE in the years when the idea was conceived and the initial decisions to invest heavily into landmark while leaving core mmorpg systems underdeveloped left the project in a fucked up place. So when they sold to Columbus Nova and Smedley left (I guess like 3 months later?) the project was already vulnerable due to most likely just being a bad idea and a confusing investment. Yeah it was experimental and that’s cool I guess. In the sea of WoW clones we ‘could’ commend him for trying, but it was a weird, almost cheap feeling, concept built on the idea the community would build the world and game for them, and that of course never had to chance to happen I think primarily because the tech sucked.

Also I tried to explain this whole THJ v EQ lawsuit to my wife who doesn’t play, did a little well poisoning against EQ and it’s ‘bad management of the ip’ and she still said sorry that sounds like THJ is stealing. She’s no lawyer but there’s a sane non-elf world dweller take for ya.

They cut the funding after 40 million abruptly without any warning. By the time SOE came into the picture it was an entirely different project with different people working on it.

That came with an entirely new game built at SOE that shared none of the original game.

So nobody really knows what Brad McQuaid could have done with Vanguard had Microsoft not backed out during pre-alpha.

no way they get away with the "not for profit" thing

they had a VIP support channel with on-demand support (which was great), and as a mediocre player with a pretty limited char, I got to beta test the new quarm

never asked for anything, but pretty sure they'd go a long way to accommodate their whales, i mean they actively approach people to make them feel special ..

What determines if something is non-profit isn't about how much money is made, but how the money is spent. There are thousands of non-profit charities that pay employees or give rewards for donations.

You say it's not a complicated case but you're talking about Daybreak mismanagement of their IP as if it's relevant to the Copyright Claim when that part has nothing to do with the Copyright portion of the lawsuit. Daybreaks mismanagement part would be relevant to the Harm claim. So you don't understand the lawsuit.

Vanguard could have been amazing but it was shoved out early to compete with TBC.

Vanguard could have been the true successor to Everquest but they shoved it out and it was a bug ridden mess they then put it into maintenance mode for years pulled it out of maintenance mode when it had like no one playing did a few things and then were like. "Welp it's dead how could this happen better sunset it"

For those who don't believe it was shoved out to try and fight TBC. Vanguard was bound to fail because of SoE's shit management.
