The Judge isn't going to give a ruling. She's going to kick it to arbitration and that's gonna make all the Daycucks cry... again.

yar it looks like it's time to replicate eqemulator.org and all the login data to a new domain/location w/ "anonymous" operators, as this piece of paper puts eq emus at about three minutes to midnight.

up next is a slow crawl to an eventual judgement against thj, and then potentially a c&d on eqemulator.org for serving as the gateway to infringing content after. everything goes down that relies on their login servers at that point, and it'd be a mess re-associating server characters to replacement logins because of all of the potential for character "theft" on previously-shared logins, so hopefully daybreak doesn't take it that far. even if they did and eqemu jumped elsewhere beforehand, it'd still be hell for p99 (and quarm?) because they rely on eqemu and wouldn't be able to continue to do so without jeopardizing their agreement(s).

thj did so many things right- as the concept, development, communication, and support were all excellent, and it brought a lot of energy back into the emu devspace. but at the end of the day, it'll be remembered as the server that would rather jeopardize 20+ years of eq emu devwork than check a box to hide the donation log, and/or listen to literally anyone about curbing their footprint so that daybreak wouldn't consider them as effectively commercial competition that needed to be stomped out. gg no re.

new docs up also from daybreak responding to thj's motion to stay the case and compel arbitration. not bothering to read the shit that cites some 30 cases as precedent as to why thj can't compel daybreak to arbitration, but they do also include the transcript from the injunction hearing that confirms that a) the thj docs w/ eq emu donation precedent were denied due to being ad infinitum/running battle (though thj's lawyer basically sputtered it out during his argument), and b) the judge's struggle with immediately ruling in favor of daybreak for the injunction was simply the fact they claimed irreperable harm beyond $ (daybreak clarified that beyond $ means things like once people get addicted to the god mode eq offered by thj, they won't go back to the original game).

beyond that- you get the impression that the judge sees it as a dunker for daybreak in terms of ip infringement, and she doesn't care about daybreak's prior enforcement policy towards other servers. it also includes that thj made 20k for the month december, was making 20k per week in june and/or july, and was making more than that at some point before then (pop release 4sure)- which is why the bond amount wound up so high (originally proposed as 5k, wound up 1 mill).

thj's defense in court also effectively amounted to #feelingsnotfacts, so this is already over.

There has been like 4 sent out total in EQ1s history and 3 of them were sent out to the same server that still exists today. None of them were public which would be requried to ignore the Equitable Estopple defense. The judge is unironically stating she thinks this over a 25 year period qualifies as sending out "C&Ds" regularly.

That's a full retard take.

Do you know nothing about how court cases work? The judge at this point will generally regard what each side says as honestly pleaded, neither side is obliged to prove anything at this point. If they say they regularly send cease and desist the judge will accept that as true and rule based on that.

Defenses don’t matter at all in outcomes at this part of the case, except for like procedural errors. You raise your potential defenses to use later at trial.

Notice the words "The Record shows" The judge is basing this off only what Daybreak submitted. There are no secret C&Ds the judge is just that fucking stupid.

Because a game that people used to love has been destroyed by people that actively go out to ruin it for other people by ways such as botting, hacking, mass boxing or making a living for it so we want to see them lose everything.

It's kinda like when you go to an all you can eat restaurant and you see that fat fuck steal all the desert and as he's mid way eating a piece of cake he starts to choke on it and you're thinking good you deserve it you fat fuck.
