He doesn't need to go into the trial with the ability to win it. Just has to get to a point where it's dangerous enough for them to want to settle.

If any lawsuit makes it to the discovery phase, most of these outlets will have some sort of documents(emails, memos etc) that say to paint Kyle in a bad light, which they really don't want want being public.

Sandmann probably had less of a leg to stand on for defamation, since there wasn't a criminal trial showing the actual facts of the case which many media outlets are purposefully lying about. He's already collected undisclosed millions, and he probably told Kyle on the phone exactly how to fuck them out of a great deal more.

This is exactly why the FBI was sent after Project Veritas, O'Keefe got far enough along in his suit that he can now depose people from the NY Times and then file for discovery and get documents. last thing the NYT wants is the public to know they intentionally lie about everything they print.

First, you need to get to trial in order to get to discovery. Barnes posits that the judge would dismiss the case very early on. He probably wouldn't even make it to discovery. He talks about settlements as well. A settlement is usually a fraction of what the claim is, is it even worth it? The memes have Sandman getting a lot of money but his lifestyle since getting it suggests he didn't get as much as the meme makes out to be. Barnes himself can't come out and say how much Sandman got as he is in close enough proximity, after representing other covington kids, that it might null Sandman's NDA but he's telling us its a lot less than has been reported.

Sandmann seems like a smart kid that isn't going to go out and buy 5 Lambos the second he gets the cheque, and plenty of people who have tons of money live way below their means.

Got streamers like Asmongold who's lived in what many people would consider squalor in the house he grew up in, but he admitted with the twitch leak a few months ago he's got millions in the bank.

That being said, most of the time you see lawsuits like this, they file for hundreds of millions. Even if you only get 1% of your claim of lets say...$250 million. That's $2.5 mil. That's plenty enough for most people to set them for life, on top of sending the message that the lies they peddle ruining your reputation are at least going to cost them something, even if it's nothing to a megacorp in the long run.

Barnes was in close proximity to the case as he was representing other convington kids. He can't come out and say how much Sandman got because of Sandman's NDA but he's still telling us its a lot less than what has been reported in a roundabout way.
