Judging by pictures I've seen of racial slurs and other stuff that got you instantbanned on most other games I'd say they don't ban for anything but piracy.

Apparently easy enough that it's actually listed as something to be wary of if you buy a used 360 on a number of sites. (And keep in mind Gamestop won't accept modded ones [or isn't supposed to] so it shouldn't be from modding the console)
Even that isn't an Xbox Live ban, they ban that console only. Not that I have experience ... twice

This is just the first week post-reveal. A lot of people haven't gotten information about the console yet. Plus MS still has a lot of time to change direction, but any company that's shown the current xbone with high hopes probably isn't smart enough to change course now.

Even if some publishers weren't willing to allow disabling of their online components in their current games in development Microsoft could still remove the global online requirement and get a lot of good will back. Same with the kinect.

Tried discussing PS4 vs Xbone on a primarily Texas football forum. Those idiots were just spouting back MS PR bullshit like always online will allow for amazing advances and the console is future proof. Funny thing is for the "future proofing" (i.e. 'the cloud') PS4 actually has a proven cloud computing variant and they're going with a brand new one. But they're currently downplaying it, likely since the actual results for the end user are questionable.
