Those programs weren'tallbad when they were being used to spy on terrorists and their financial backers. Obama using them to spy on, harass, and intimidate his political opponents in the US is where things went to shit. Some of my AISD police friends say they've been given software that allows their IE browsers to ignore facebook privacy settings, and look at anyone's personal info/posts/pics. It's bad enough with the NSA doing this shit, now its glorified highschool security guards being given the power through inter-agency cooperation. Odds of similar shit happening with kinect?

But a surveillance warrant from the FISA court could easily compel Microsoft to transmit recordings from Kinect -- they wouldn't have a choice but to do it. Since the kinect has recording capacity and is always listening, it seemingly wouldn't take much to transmit that audio back to Microsoft.
