Having seen their response to secrets/quarm, I no longer think they care about money directly. They exclusively want a population on live eq and emus must not compete on an innovative level, they can only provide classic style appeal that brings people back to the game and lets "real" eq offer the bells and whistles.
Which has me from 99% to now 99.9% certain that they are either embezzling or profiting off the side from rmt. They dont care about thj or quarm or any others making some profit for them through licenses when they are basically congressional insider traders of live eq and emus give them no access that way.

Like I get it's completely within their right to do what they are doing, and I'm biased because I have such a seething fucking hatred for Daybreak and boxers/botters for turning a game that played such a major role in my childhood get legit destroyed but for this entire fucking thing to start from a single Anonymous tip email... Like are you fucking kidding me?
Was it some Kronolord faggot that noticed a drop in their sales? Was it some dickrider that got banned? This legit builds such a bullshit thing for emu servers now. Some random cocksucker could just send them a E-mail with a bunch of shit saying yeah they're making money. Someone should report Daybreak to FinCEN for money laundering or some shit.

I agree that lawsuits like this tend to have a chilling effect, and I understand why some see it as a clear-cut legal matter. But I think what’s getting lost in all this is the broader failure of imagination and leadership on Daybreak’s side.
This lawsuit should raise serious questions about Darkpaw’s direction and long-term viability. When a fan-run server built by two unpaid volunteers draws 29K daily users on their Discord server and daily server pop of 8,600 that is not just a legal liability. It is a brutal indictment of the studio’s ability to create something people care about. If I were Jen Chan, I would be more worried about getting fired than celebrating a temporary legal win.
The legal team miscalculated. They thought this would be a quiet cleanup operation. Instead, they handed the world a headline: two hobbyists built something better than Daybreak could. That makes this a Pyrrhic victory. They might win the case, but they’ve exposed just how badly they’ve been outclassed. If I’m at EG7 right now, I’m reevaluating whether this executive team is fit to lead anything.

Daybreak is basically guaranteed to lose money because of this lawsuit. THJ has an LLC that they will simply go Chapter 7 on if they lose, they simply haven't taken in enough that DBG will get enough $$ for it to be worth it. The general sentiment seems to be fuck daybreak regardless of if they win or lose. It's a massive L for them when people are clearly over the slop they put out on both Live and TLPs.
For what it's worth Google AI seems to think Daybreak is going to lose the case.

to be fair that email was from early december last year? THJ had only launched a few weeks earlier.
that was clearly some botter/krono scammer PLer or some shit who lost some business, maybe even a GM who was running a a bunch of bots on the side.

There were no noticeable sales decline in krono from what I saw. Teek had increased overall sales in the 3rd party market and there was no decline until Fangbreaker was announced.
I would bet this email was from a guild member who lost a lot of guildmates to the server.

But I agree with the larger sentiment that Daybreak likely loses no matter what unless they figure out a way to embrace the opportunity right in front of them. But I am certain they wont.

The AI really only looks at the DBG complaint since THJ hasn't submitted their defense yet, so the AI doesn't consider potential counter arguments. For example in regards to Daybreaks irreparable harm claim, if you ask about the defense offering up a counterclaim that says daybreaks losing subs not because of THJ, but rather because they've put out a TLP that wasn't well received or the rampant botting/cheating they allow the AI says the counterclaim is much more likely to win in court. If you mention the relevant case law like https://en.wikipedia.org/wiki/Micro_Star_v._FormGen_Inc. and explain the ruling, then explain how that compares to EQEMU it says Daybreak likely abandoned it's copyright when comes specifically to modify the server files and such(the tampering claim). Finally if you mention what would happen if THJ showed they were non-profit and the "donations" are actually just donations at that point it says Daybreak has a good chance at winning only Innocent infringment, which would likely result in THJ getting shutdown and DBG getting no $$, which is the worst possible outcome for Daybreak if you really think about it.

I stand corrected, it was 29k+ users on the THJ Discord. The server pop. on THK was 8,600. That's still way more than the official EQ discord and Fangbreaker which is embarrassing for Daybreak/Darkpaw.
