Uh, what? It absolutely meets the elements of murder. The only reason he got off was because of the Texas law that allows people to use deadly force to recover property during a nighttime theft. That was the central argument of the defense.
Intent wasn't to killbut to retrieve his stolen property.

Are you agreeing with me? He shouldn't have been tried for murder because of that law, it's a valid defense from prosecution in Texas. If he were to have been charged with manslaughter they might have been able to make it stick.

I'm sure you are right about other states but I don't know most of their deadly force laws.

The four states of mind recognized as constituting "malice" are:
Intent to kill,
Intent to inflict grievous bodily harm short of death,
Reckless indifference to an unjustifiably high risk to human life (sometimes described as an "abandoned and malignant heart"), or
Intent to commit a dangerous felony (the "felony-murder" doctrine).

Try to be less ignorant.

Uh, he should have been tried for murder because what he did was murder, and meets every element of murder. It's not recovering stolen property when you're breaking the law and trying to solicit an illegal act.

*edit*

And regardless, that isn't how the law works. You don't just get to say 'oh i was trying to recover stolen property' and then nobody gets to file charges against you. If the prosecution feels your assertion is unreasonable, you get charged. They were right to charge him with murder, and the jury was a bunch of retards for acquitting him.

There's no "assumptions" when you're paying for an escort. The only reason sex isn't mentioned outright is because its illegal to do so.
Right, and since it isn't mentioned it's an assumption. Since it never can be explicitly stated there's always the possibility that some dumb bimbo actually think she'll get paid to go on dates with guys. And I'm sure there are actually some guys who really think they're paying for a date (admittedly extremely rare).

that wasn't the focus of the ruling. It was to "retrieve" his stolen property. No intend to harm or to kill, but to retrieve his shit.

Would you be ok with convicted thieves being put to death as well, after the fact, or is it only a "die on the scene" kind of justice? Honest question.
Convicted thieves aren't an immediate danger to me. Garden gnome thieves in my front yard are. I can't read your mind to gauge your intentions, and you aren't getting the benefit of the doubt while my wife and 6 month old son are home. Even if I was home alone for that matter.

oof if serious better hope you're in a free-state. that's murder most everywhere, brother.

also good for you if you plink a guy infiltrating your garden say over 30 feet away from you. assuming you're not stepping outside with a rifle or a barreled shotgun anyways.

I'm glad this guy got off, and don't give a shit about the hooker/scam artist.

Prostitution should be legal anyway. Only crazy bible-thumping Tea Party-ers think it's wrong. Most countries with universal health care also have some form of legal prostitution. Had prostitution been legal in this case, the whore'd still be alive as this gentlemen would then have legal recourse to recoup his monetary losses.

Mark this day down in history, BoldW said something that makes sense.

Disregarding the question of legality, do you really want a guy that flips out and kills someone over $150 armed and lose in society?
